Overview
The challenge of our generation is to make a just transition to a zero-carbon global economy, and move towards a new economic paradigm, underpinned by a legal framework that works for all stakeholders. If we are successful, it will be humanity’s greatest ever political, economic and social transformation – and achievement.
The world needs lawyers to step up to protect our planet and ensure justice and equity are served. GAIL’s impact lawyer community is redefining the law and legal practice by designing new corporate and financing structures, drafting new legislation, policy and guidance, and bringing seminal cases.
Highlights
GAIL’s Mid-Year Global Event will bring together our global community to explore the role that lawyers can play in facilitating a just transition and moving towards a new economic paradigm. It will include:

The Regulation of Impact Funds
Moderated by: Simon Witney, Senior Consultant,

Regulatory interventions could give a helpful boost to the market for impact funds, but defining an impact fund and designing an appropriate regulatory framework is challenging. This panel will discuss various proposals to regulate or label impact funds, in particular the UK FCA’s proposed disclosure and labelling regime. Panellists will also cover Article 9 of the EU SFDR, recent SEC proposals in the US, and the proposed “Just Transition” Label, an initiative led by the Impact Investing Institute.
Should Impact Investing be ‘Efficient’?

This panel will discuss what ‘efficiency’ might mean in the context of impact investing, asking questions such as: How might we define efficiency in impact decision making and the allocation of impact capital? Who controls that definition and do the beneficiaries get a say? How could efficiency be integrated into an impact strategy? What does efficient impact investing look like and what role could the law play in mandating efficiency through contract or regulation?

The SEC Takes on Greenwashing – Proposed Rulemaking on Impact & ESG
Moderated by: Elizabeth Lange, Partner, Faegre Drinker
While the ESG landscape has evolved rapidly, regulators in the U.S. have been slower to act. Responding to growing concerns over greenwashing and the lack of standards in ESG measurement and reporting, the SEC announced three major rule proposals in 2022 targeting these issues. This panel will provide an overview of the SEC’s proposals regarding public company climate risk disclosure and ESG investment strategies and amendments to the Fund Names Rule, and lead a discussion of the risks, challenges and considerations that face legal practitioners in the evolving U.S. regulatory environment.
